On April 10, Gabriella White, a family of brands composed of Summer Classics, Gabby and Wendy Jane based in Pelham, Alabama, resolved a yearlong lawsuit against Costco for both design patent infringement and trade dress infringement.
Summer Classics, a leading designer and manufacturer of premium outdoor furniture, recently enforced its patent rights against Costco, a multinational membership-only retail outlet, for infringement of patent and intellectual property rights in response to the sale of low-cost, replica outdoor seating collections originally created and popularized by Summer Classics. The suit was filed on April 24, 2023, in the U.S. District Court of the Western District of Texas in the Waco Division.
The lawsuit was settled amicably with Costco; the membership retailer agreed to cease sale of the disputed product and to provide a payment of an undisclosed amount to Gabriella White LLC.
